Terms & Conditions
These Terms explain how you may use the Magau app and services. Please read them carefully - by using Magau, you agree to them.
1. Agreement to terms
These Terms & Conditions ("Terms") form a legal agreement between you and Magau covering your use of the Magau mobile app, website and related services (together, the "Service"). By downloading, accessing or using the Service - including browsing or placing an order - you confirm that you have read, understood and agree to these Terms and to our Privacy Policy, which is incorporated here by reference.
If you do not agree with these Terms, please do not use the Service.
2. Who we are
Magau (मगाऊ) is an on-demand delivery service operated by Bricks Education, a company based in Nepal. In these Terms, "Magau", "we", "us" and "our" refer to Bricks Education operating under the Magau brand.

3. Eligibility
The Service is intended for users aged 16 and above who are able to form a legally binding contract under the laws of Nepal. By using the Service you confirm that you meet these requirements. The Service is not directed to children under 16, and we do not knowingly allow them to create an account.
4. Your account
You sign in to Magau using your mobile phone number and a one-time SMS code (OTP). You may browse the app anonymously, but you will be asked to sign in to place an order or to use account features such as saved addresses, order history and your Magau Wallet.
- Keep your phone number and device secure, and do not share the one-time codes sent to you.
- You are responsible for all activity that takes place through your account.
- Please provide accurate information and keep your delivery details up to date.
- Tell us promptly at contact@magau.app if you believe your account has been used without your permission.
5. About the service
Magau is a marketplace and intermediary. We connect you with independent third-party vendors - restaurants, home kitchens, and neighbourhood grocery and daily-goods stores - and with independent delivery partners ("riders") who carry orders to you.
Vendors prepare and sell the goods; riders deliver them. Magau is not the manufacturer, producer or seller of the goods offered through the app. The vendor is responsible for its products, including their quality, safety, description, pricing, packaging, and compliance with all applicable laws.
Home services (such as plumbing, electrical, cleaning and salon-at-home) are planned for the future and not yet available. Any reference to them is a preview only and does not form part of the live Service.
6. Orders & the contract
When you place an order through Magau, you are making an offer to buy the selected items from the vendor. The sale contract for the goods is formed between you and the vendor once the vendor accepts your order. Magau facilitates the ordering, delivery coordination and payment on the vendor's behalf.
- Orders are subject to vendor acceptance and item availability; a vendor may decline or be unable to fulfil an order.
- Where an item is unavailable, the vendor may propose a substitution or a partial fulfilment; you will be informed and, where the amount changes, charged only for what is provided.
- Menus, listings, item details and availability are provided by vendors and may change at any time.
7. Pricing, fees & taxes
Prices are set by vendors and shown in Nepalese Rupees (NPR, "Rs"). Delivery fees and any applicable taxes are shown to you before you confirm checkout. The total amount displayed at checkout is the amount you will pay for that order.
Prices and fees may vary between vendors, locations and times. We take care to keep information accurate, but occasional errors can occur; where a genuine pricing error affects your order, we or the vendor will contact you.
8. Payments
You can currently pay using:
- Cash on Delivery (COD) - paid to the rider when your order arrives.
- Magau Wallet - in-app store credit used to pay for orders and to receive refunds.
The Magau Wallet is store credit only. It is not a bank account or an e-money service, it is non-transferable, it does not earn interest, and it may be used only within the Service. Online payment gateways (such as cards, eSewa or Khalti) may be added in the future; they are not available today.
9. Delivery
Estimated delivery times shown in the app are estimates only and can be affected by preparation time, distance, traffic, weather and demand. To receive your order:
- Make sure the delivery address and map pin you provide are correct.
- Ensure that you or someone able to receive the order is available at the delivery location.
- Be reachable on the phone number linked to your account so the rider can coordinate handover.
If a delivery cannot be completed because no one is available or the address is incorrect, additional charges may apply and a refund may not be possible.
10. Cancellations & refunds
Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. Whether an order can be cancelled depends on how far along it is in preparation and delivery. Where a refund is due, it is issued to your Magau Wallet.
11. Ratings, reviews & content
You may submit content through the Service, such as ratings, reviews, photos and support messages. You are responsible for what you submit, and it must be honest, lawful and your own to share.
By submitting content, you grant Magau a non-exclusive, royalty-free, worldwide licence to host, use, reproduce and display that content for the purpose of operating and improving the Service. We may moderate, decline to publish, or remove content that is unlawful, misleading, abusive or otherwise breaches these Terms.
12. Acceptable use
When using Magau, you agree not to:
- Use the Service for any fraudulent, unlawful or abusive purpose.
- Place false, fake or bad-faith orders.
- Order any item that is illegal to buy or that you are not legally permitted to purchase.
- Harass, threaten or mistreat vendors, riders or our staff.
- Interfere with, tamper with, reverse-engineer or attempt to disrupt the app, its security or its infrastructure.
- Misuse promotions, wallet credit or referral features, or attempt to gain benefits you are not entitled to.
13. Vendors & riders
Vendors and riders are independent partners who operate under separate partner agreements with Magau. These Terms are directed at customers using the Service. If you are a vendor or rider, the terms that apply to you are set out in your respective partner agreement and the Vendors and Riders information we provide.
14. Intellectual property
The Magau name, the Magau logo, the app, its design, and all related content and software are owned by Magau / Bricks Education or its licensors and are protected by law. You may not copy, modify, distribute, or use our brand, logo or materials without our prior written permission. Nothing in these Terms transfers any of our intellectual property rights to you.
15. Third-party services
The Service relies on trusted third parties - for example, mapping and live-tracking, SMS delivery, push notifications, hosting, analytics and diagnostics. Their services are governed by their own terms and policies, and their availability is outside our control. Our Privacy Policy lists the providers that may process personal data on our behalf.
16. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties of any kind regarding the Service, including its uninterrupted availability, accuracy or fitness for a particular purpose.
The goods you order are supplied by independent vendors, who are solely responsible for them - including quality, safety and legal compliance. We do not guarantee that the Service will be free of interruptions, delays or errors.
17. Limitation of liability
To the extent permitted by the laws of Nepal:
- Magau is not liable for the acts, omissions or products of independent vendors or riders.
- We are not liable for indirect, incidental, special or consequential losses arising from your use of the Service.
- Where liability cannot lawfully be excluded, our total liability to you for any claim relating to an order is limited, to the extent permitted by law, to the amount you paid for that order.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the applicable law of Nepal.
18. Indemnity
You agree to indemnify and hold harmless Magau and Bricks Education from any claims, losses, liabilities and reasonable expenses arising out of your misuse of the Service, your breach of these Terms, or your violation of any law or the rights of a third party.
19. Suspension & termination
We may suspend or terminate your access to the Service, in whole or in part, if you breach these Terms, engage in fraud or abuse, or where we are required to do so by law or to protect the Service, our users or our partners. You may stop using the Service at any time and may request account deletion (see the Account & Data Deletion page).
20. Governing law & disputes
These Terms are governed by and construed in accordance with the laws of Nepal. Any dispute arising out of or relating to these Terms or the Service is subject to the exclusive jurisdiction of the courts of Nepal.
21. Changes to these terms
We may update these Terms from time to time. When we do, we will post the revised version here with a new effective date. Significant changes will be communicated where appropriate. Your continued use of the Service after an update means you accept the revised Terms.
